Our team seeks a full-time Federal Immigration Litigation Attorney to work exclusively on federal cases, supporting our attorneys handling administrative cases by providing strategic analysis, opinion memos, and comprehensive legal briefs on critical immigration issues.

Job Description:
The Federal Immigration Litigation Attorney will take on the primary responsibility for handling federal immigration cases from start to finish, including drafting and filing complaints, motions, and briefs, and representing clients in federal court. This role also includes providing legal support to our administrative-level attorneys by producing detailed internal opinion memos on complex immigration matters, crimmigration issues, and other critical points of law. This position is ideal for an attorney with a strong federal litigation background who can work independently on federal cases and provide in-depth legal analysis to strengthen our firm’s administrative-level strategies.

Primary Responsibilities:

  • Federal Immigration Litigation: Manage federal court cases involving complex immigration issues, including but not limited to:
    • Administrative Procedure Act (APA) challenges for unreasonable delays or wrongful denials.
    • Mandamus actions compelling federal agencies to perform owed duties within reasonable timeframes.
    • Habeas Corpus petitions challenging unlawful detentions by federal authorities.
    • Bivens actions and FTCA claims for constitutional or tortious violations by federal officers.
  • Legal Support for Administrative Attorneys: Provide expert legal analysis and support through internal memos and research-based briefs on immigration issues affecting administrative cases. This includes analysis of custody issues, crimmigration cases, deportation-related legal challenges, and federal tort claims.
  • Internal Legal Opinions and Strategy: Draft detailed opinion memos on challenging legal questions, providing guidance to attorneys working on cases before agencies like EOIR, USCIS, and DHS. Develop and recommend strategies to support cases that may eventually lead to federal litigation.
  • Complex Legal Briefs: Draft, research, and prepare high-quality briefs and memoranda for federal litigation and provide additional guidance to administrative attorneys to enhance the firm’s case preparation and success rate.

  Required Experience and Expertise: The successful candidate must be experienced in at least three of the following areas:

  1. Administrative Procedure Act (APA) – Experience challenging agency actions that are arbitrary or unreasonably delayed.
  2. Mandamus Act – Compelling action by federal agencies for non-discretionary duties owed to clients.
  3. Habeas Corpus – Filing petitions to challenge unlawful detention in federal court.
  4. Bivens Actions – Litigating constitutional violations by federal officers.
  5. Federal Tort Claims Act (FTCA) – Pursuing damages for wrongful actions committed by federal employees in an immigration context.

Qualifications:

  • J.D. from an accredited law school; active bar membership in at least one U.S. state.
  • Minimum of 3-5 years of experience in federal immigration litigation.
  • Demonstrated expertise in drafting comprehensive legal briefs, opinion memos, and research-based internal memoranda for federal litigation support.
  • Excellent legal research, writing, and oral advocacy skills, particularly in federal court settings.
  • Strong ability to collaborate with administrative-level attorneys and provide legal support that enhances case outcomes.
  • High ethical standards, compassion for clients, and dedication to advancing immigrant rights.

Compensation details: 100000-150000 Yearly Salary
